Mercury & lawyer firm prepares Immigrant Visa Petition

Mercury sends agreement and documentation to nurses for his/her signatures.

Nurse will sign and send the documentation to Mercury.

Mercury will send Immigrant Visa Petition to INS

INS will send a receipt notice to Mercury

INS will send after 5-6 months (usually) the outcome of the petition.

Mercury will update to Nurse on the above.

After Immigrant visa petition approval by INS, Mercury will arrange the packet to the Nurse to do consular processing outside the United States.

This completes the process of visa petition.
Initial Filling I-140 – Two to Three Months
I-140, 750B, CGFNS Certificate, English Exam Required Score, Copy of nurse’s education/licensure/registration/experience/resume/passport papers, company brochure, cover letter, petition supporting letter, Notice of job availability/Certification (10 days internal posting)
Visa Processing for Family Members — Two to Four Months
While the 1-140 Immigrant Visa Application for a Schedule A, Group I Registered Nurse is in process, will send immigration forms for the family. 1-134 (Affidavit of Support) and Department of State Forms DS-230 I and II (Application for Immigrant Visa and Alien Registration). Each family member also completes DS 230 I and II Forms. The Family Petition Forms are not needed until after the I-140 Visa is approved.
After the 1-140 Visa is approved, the petition is sent from the Service Center to the National Visa Center (NVC). Information is entered into the NVC system and we will receive an invoice for Consular Processing Fees. Will pay this fee for our Nurses. The Nurse pays this fee for each immigrating family member. In addition, the Nurse pays for family legal fees.
After payment of fees, the NVC sends a request for forms. We will submit the Forms mentioned above
Consulate Interview — Two to Four Months
The National Visa Center sends immigration information to the appropriate U.S. Consulate Office. That Office issues a date for the Interview and provides a list of authorized physicians from whom the Nurse and family members must get physicals.
We will provide supporting petition documentation including an updated Offer Letter.
The Nurse and all family members process at the Consulate together. After interview they will receive a Visa Approval Notice from the Embassy. They will be issued an authority to travel to the U.S. for Employment Purposes. Their Green Card is issued after their arrive in the United States.
Timeframe from I-140 Approval through Consulate Processing and Interviewing
The time frame from 1-140 Approval through Consulate Processing averages 6 months.
Travel, relocation and housing expenses for family members are paid by the Nurse. We will provide housing for the Nurse only for 30 days. After that time, the Nurse is responsible for housing expenses.
